National Parks and Wildlife Regulation 2019 Aboriginal Cultural Heritage Assessment Mt Arthur Coal Mine Modification Muswellbrook LGA, NSW Hunter Valley Energy Coal Pty Ltd Private Mail Bag No. 8, Muswellbrook NSW 2333 This notice is advertised in accordance with clause 60(2) (c) of the National Park and Wildlife Regulation 2019. The Mt Arthur Coal Mine (MAC) is owned and operated by Hunter Valley Energy Coal Pty Ltd (HVEC) (the Proponent) and is situated in the Upper Hunter Valley. The Proponent is preparing an application to modify NSW Project Approval 09 0062 to continue mining activities to 30 June 2030 which would involve a minor extension to the disturbance area in the north-west portion of the mine (refer to Figure 1) (the Modification). The Modification would be subject to environmental assessment and approval processes under section 4.55(2) of the Environmental Planning & Assessment Act 1979. Niche Environment and Heritage (Niche) has been engaged by the Proponent to prepare an Aboriginal Cultural Heritage Assessment (ACHA) in accordance with the Aboriginal Cultural Heritage Consultation Requirements for Proponents (Department of Environmental, Climate Change and Water, 2010), Niche will be undertaking the ACHA to identify cultural values and assess the potential impacts of the proposed activity to any Aboriginal cultural heritage sites or places within and in the vicinity of the Subject Area. In accordance with Section 4.1.3 of the Aboriginal Cultural Heritage Consultation Requirements for Proponents 2010, Niche is seeking to consult with any Aboriginal persons or groups who may hold cultural knowledge relevant to determining the significance of Aboriginal objects and/or places in the Subject Area, or who have a right or interest in Aboriginal cultural heritage of the Subject Area. The purpose of the Aboriginal community consultation will be to assist the Proponent in the preparation of the ACHA and identify appropriate management recommendations for any Aboriginal objects or places within or in the vicinity of the Subject Area.
